As a business that generates hazardous waste, you and the organisations involved in its disposal must demonstrate, both to one another and to the relevant authorities, that the waste has been disposed of properly, and must keep the necessary supporting documentation.
Even before disposal begins, you, as the waste-generating company, must keep disposal records in order to demonstrate that the planned method of disposal is permissible.
The competent authority must confirm the permissibility of the disposal before disposal begins.
The obligation to confirm the waste disposal records does not apply in the so-called ‘privileged procedure’. This applies to the following companies:
- disposal facilities that are certified as specialist waste management operators, or
- waste disposal facilities belonging to a company listed in the EMAS register; or
- waste disposal facilities which have been exempted from the confirmation requirement by the competent authority upon application.
Under the ‘privileged procedure’, disposal may commence immediately after the waste disposal certificate has been sent to the competent authority.
